Understanding the Reality of Uncontested Divorces in Georgia


Why are there so many uncontested divorce lawyers in Georgia? Are most divorces in Georgia contested or uncontested? 


The truth is only a small percentage of divorces are uncontested. Truly uncontested divorces are normally short-term marriages, with no children, no assets and no debt. The divorces are uncontested because there is nothing to argue about. 


And that's rare. Most people like to think they can get an uncontested divorce. They imagine a quick, low cost, alternative to divorce with fewer headaches than most divorcing couples. The reality is that it's not easy to reach agreement on how to split assets, divide debt, provide for children and reach agreement on parenting issues. We all tend to live complicated lives and if it were that easy to reach agreement on the things that matter to us, there would be far fewer divorces in Georgia.


It's not easy to divorce and it's not always possible to agree on everything concerning your divorce. Rather than trying to convenience yourself that an uncontested divorce is the best thing for everyone, think about what is best for you (and your children if you have any) in 6, 12 or 24 months. Rushing into an uncontested divorce may not be in your best interest in the long run. 


If you hire an uncontested divorce lawyer in Georgia, make sure you know what you are doing. Many uncontested divorce attorneys in Georgia will withdraw from your case if your divorce becomes uncontested. So if your uncontested divorce does become contested, you will have to hire a second lawyer, and incur far more expense, simply because your uncontested divorce attorney is unwilling to handle a contested cases. 


Some uncontested divorce attorneys in Georgia are unwilling or unable to go to court. And if you hire an attorney who is unwilling to go to court in the event settlement negotiations break down, you may not be getting the best advice in your divorce. That's like getting advice from an emergency room doctor who is unwilling operate.


From an attorney's perspective, it's easy to specialize in uncontested divorces. Uncontested divorces are easy, no stress cases that don't require much effort. Which is why uncontested divorce attorneys in Georgia are a dime a dozen. It only takes a few minutes to find a cheap divorce lawyer to file an uncontested case. It takes a lot longer to find an attorney with the skills training to advise you of the risks and rewards of a particular agreement and the confidence to back you up in court if the negotiations fall apart.


Final divorces are final. If you wake up six months after the divorce is final and realize you've made a mistake, it's usually to late to do anything about it.
